3. How To Enter: During the Submission Period, enter at www.rejuvenation.com (the "Website"). Register by entering your true and correct information on the Registration Page (required fields include email address, first name, last name, city, state), entering the title of your remodeled room, a short description of your remodeled room, and uploading 3 photos of your remodeled room. The use of Rejuvenation products in your remodeled room are not a requirement to enter the contest and will not affect the ability to be a Potential Winner. To be entered in the Contest during the Submission Period, you will need to upload at least 1, but not more than 3 photographs of your remodeled room (a "Photo"). Photographs should be demonstrative of the room. The only acceptable photography format is jpg; each file size should be no bigger than 100k; recommended photo dimensions are 500x375 pixels. Limit of one (1) entry to the Contest per person for the entire Promotion Period. If it is discovered that you have registered or attempted to enter the Contest more than once, all of your entries may be declared null and void, and any prize you might have been entitled to may not be awarded. BY SUBMITTING A PHOTO, ENTRANT ACKNOWLEDGES THAT HIS/HER PHOTO MAY BE POSTED ON REJUVENATION.COM, OR USED IN REJUVENATION PROMOTIONAL MATERIAL. Rejuvenation reserves the right to monitor/screen Photos prior to posting them to the Website. Submission of a Photo grants Rejuvenation an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the Photo in any way, in any and all media, without limitation, and without consideration to the entrant. Entrant affirms that the photo does not include: (a) any copyrighted works without permission of the copyright owner, (b) false or defamatory statements about any person or any third party; (c) any third party trademarks which suggest affiliation with any trademark owner without permission of such owner or that dilute the value of any trademark; (d) any act which is dangerous or suggests any person to undertake a dangerous activity. Entrant warrants that publication of the Photo via various media including Web posting, will not infringe on any third party rights. Any such entrant will indemnify and hold harmless, Rejuvenation, from any claims to the contrary.
4. Submission Criteria: During the Submission Period (April 3, 2009-May 1, 2009), each entry will be monitored/screened by Rejuvenation and published to the website (Rejuvenation.com), within 48 business hours. At Rejuvenation's discretion, Rejuvenation reserves the right to omit entries based photographic or written content deemed inappropriate for public viewing. Rejuvenation also reserves the right to publish photo entries in random order. In the event that more than fifty (50) entries are received, Rejuvenation reserves the right to narrow the submissions posted for Voting to a manageable number. The number of entries posted for Voting is solely at Rejuvenation's discretion.
5. Voting Period: To vote on a Contest submission during the Voting Period, simply enter your email address and vote on one of the Contest entries (no photo upload is required during the Voting Period). Limit of one (1) Vote per person during the Voting Period. If it is discovered that you have attempted to vote more than ONCE, all of your votes may be declared null and void. By submitting your email address to cast your vote, you agree to sign-up on Rejuvenation's email list.
6. Winner Notification/Prize Award: At the end of the Voting Period (May 31, 2009 at 4:59 PM PST) a representative of Rejuvenation will tally the votes obtained for each individual entry during the Voting Period. The odds of winning depend on the total number of votes each eligible entry received. The entry with the most votes at the end of the Voting Period will be deemed the "Potential Winner". In the event of a tie, Rejuvenation will determine the Potential Winner of the Contest. Potential Winners of prizes will be contacted by email, with instructions on how to claim the prize. If a Potential Winner is found to be ineligible, declines to accept a prize, Rejuvenation is unable to contact a Potential Winner within a reasonable period (not to exceed 4 weeks), or in the event that a prize confirmation or prize is returned undeliverable, the prize will be forfeited and, at Rejuvenation's sole discretion, prize will be awarded to an alternate Potential Winner selected in the same manner. Once a "Winner" is verified, Rejuvenation will ship the prize; please allow for reasonable mailing time. Rejuvenation shall not be held responsible for any delays in awarding prizes for any reason outside of their control. Prizes will only be delivered to the verified Winner. By accepting a prize, the Winner consents to the use of their names, addresses, and photos, and statements relating to the Contest, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by Rejuvenation or any related entities in any and all media now known or hereinafter developed without territorial or time limitation, except where prohibited by law.
7. Prize: The prize is a $1,000.00 gift certificate to be used at any Rejuvenation retail store, website (Revjuvenation.com), or via catalog or phone purchase. Rejuvenation gift certificates cannot be exchanged for cash, and Rejuvenation does not give cash refunds for unused portions of gift certificates. Rejuvenation will issue a new gift certificate for any unused balance which will be produced once an order has been shipped in its entirety.
8. General Prize Conditions: Prizes are non-transferable, non-refundable and must be accepted as awarded. No cash or other substitutions may be made, except by Rejuvenation who reserves the right, in its sole discretion, to substitute any Prize (or portion thereof) of comparable or greater value. Prizes will be awarded "as is" with no warranty or guarantee, either express or implied by Rejuvenation. The Winner is solely responsible for any and all applicable federal, state and local taxes and other costs and expenses associated with Prize receipt and use not specified herein as being provided and Rejuvenation will not withhold any taxes from the prize. Rejuvenation will issue a 1099 to the Winner for all prize winnings.
9. Eligibility: To enter and be eligible to win, you must be a legal resident of the 50 United States or Washington, D.C., be 18 years of age or older at time of entry, and have a valid email address.
